The short version:
These Terms of Use ("Terms") govern your use of Drift: Word Ladder ("Drift", "the app"), developed and operated by Mark Webber ("we", "us"). By installing, accessing, or using Drift, you agree to be bound by these Terms and by Apple's Standard End User License Agreement, which applies to all apps distributed via the App Store unless a custom EULA is provided. If you do not agree, do not install or use Drift.
We grant you a limited, non-exclusive, non-transferable, revocable license to download and use Drift on any Apple-branded device that you own or control, in accordance with the App Store Terms of Service and Apple's Standard EULA. This license does not transfer ownership of the app or its content to you.
You may not copy, modify, reverse-engineer, decompile, sublicense, rent, lease, sell, redistribute, or create derivative works of the app, except as expressly permitted by applicable law.
Drift offers optional Drift+ auto-renewing subscriptions and a one-time lifetime purchase that unlock additional features (the full puzzle archive, premium badges, and solution reveal).
Pricing (USD; equivalent in your local currency may vary):
Drift+ Monthly — $2.99/month after a 7-day free trial
Drift+ Yearly — $19.99/year
Drift+ Lifetime — $14.99, one-time, non-recurring
Auto-renewal. Monthly and yearly subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the period ends. Your Apple ID account will be charged for renewal within 24 hours of the period end at the displayed price. You can manage and cancel subscriptions at any time in iOS Settings → [Your Name] → Subscriptions, or via the "Manage Subscription" link inside the app.
Free trial. If you start the 7-day free trial on a monthly subscription, you will not be charged during the trial period. If you do not cancel before the trial ends, your subscription begins automatically and your Apple ID is charged at the monthly rate. Trials are available once per Apple ID and per subscription group.
Lifetime purchase. A one-time payment that grants permanent access to Drift+ features for the purchasing Apple ID, as long as Drift remains available in the App Store. The Lifetime purchase is non-recurring and not refundable except as required by Apple's refund policy or applicable law.
All purchases of Drift+ are processed by Apple and are subject to Apple's refund policy. We do not process refunds directly. To request a refund, visit reportaproblem.apple.com and sign in with your Apple ID.
Drift+ products are eligible for Apple Family Sharing where supported. The Apple ID that made the purchase remains responsible for the transaction. Apple controls eligibility and access for shared purchases; we do not.
We may from time to time distribute promotional codes or offer codes that grant free or discounted access to Drift+. Codes are personal, non-transferable, have no cash value, and may not be combined with other offers. Codes that have already been redeemed cannot be refunded. Codes may expire as set by Apple (typically 28 days for promo codes) or by the specific offer terms.
You agree to use Drift only for personal, non-commercial purposes. You will not:
(a) attempt to gain unauthorized access to any portion of the app, its data sources, or related systems;
(b) interfere with or disrupt the integrity or performance of the app;
(c) use the app in a way that violates any applicable law or regulation;
(d) attempt to scrape, harvest, or extract puzzle data or app content for redistribution.
Drift and all related materials — including but not limited to the app's source code, design, branding, name, logo, daily puzzles, badge artwork, and copy — are the intellectual property of Mark Webber and are protected by copyright and other intellectual property laws. The four-letter English words used in puzzles are common words in the public domain; their arrangement, curation, and the surrounding game are proprietary.
Drift delivers a new puzzle each day. While we make every effort to keep puzzles fresh and the app available, we do not guarantee uninterrupted access to the daily puzzle, the archive, or any specific feature. The app may be temporarily unavailable due to maintenance, network conditions, or events outside our control. If the daily puzzle download fails, the app falls back to a cached or default puzzle so gameplay remains possible.
Drift is provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be error-free, that defects will be corrected, or that the app or the servers that make it available are free of viruses or other harmful components.
To the maximum extent permitted by applicable law, in no event shall the developer be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the app — whether based on warranty, contract, tort, or any other legal theory.
Our total cumulative liability to you for any and all claims related to Drift will not exceed the amount you paid to us (via Apple) for Drift+ in the 12 months immediately preceding the event giving rise to the claim, or USD $20, whichever is greater.
You may stop using Drift at any time by uninstalling the app. We may suspend or terminate your access to Drift, or remove the app from the App Store, at any time and without notice if we believe you have breached these Terms or applicable law, or if we discontinue the service. Termination does not entitle you to a refund of any subscription period or lifetime purchase except as required by Apple's refund policy or applicable law.
Your use of Drift is also governed by our Privacy Policy, which describes what data the app does and does not collect.
We may update these Terms from time to time. The updated version will be posted at this URL with a revised effective date. Material changes will be noted in the in-app release notes for the affected version. Your continued use of Drift after changes take effect constitutes your acceptance of the revised Terms.
These Terms are governed by the laws of the jurisdiction in which the developer resides, without regard to its conflict-of-law principles. Any dispute arising from or related to these Terms or your use of Drift shall be resolved in the courts of that jurisdiction, except where applicable consumer protection law gives you the right to bring action in your local courts.
Nothing in these Terms limits your statutory consumer rights in your country of residence, including (where applicable) rights under the European Union's consumer protection directives, the United Kingdom's Consumer Rights Act 2015, and the Australian Consumer Law.
You acknowledge that Apple Inc. and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you as a user of an app distributed through the App Store. Apple is not responsible for the app or its content and has no obligation to provide any maintenance, support, or warranty service in connection with the app.
